Liability Waiver & Terms of Use

By purchasing this package, I do hereby consent to participate in a corrective exercise program that may include modification to my posture, movements of daily life, and exercise-based movements such as weight-lifting and running form and mechanics. Because physical exercise can be strenuous and subject to risk of serious injury (including but not limited to musculoskeletal injury, spinal injuries, abnormal blood pressure responses, and rare instances heart attack or death), it is urged that I obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. I agree that by participating in physical exercise or corrective exercise activities, I do so entirely at my own risk. Any recommendation for changes in diet including the use of food supplements, weight reduction and/or body building enhancement products are my responsibility and I agree that I have been informed to consult a physician prior to undergoing any dietary or food supplement changes. I agree that I am voluntarily participating in these activities and assume all risks of injury, illness, or death. This waiver and release of liability includes, without limitations, all injuries which may occur as a result of; a) my participation in any activity, class, program, exercise correction, supervision, or instruction, b) instruction, exercise correction, supervision, or dietary recommendations made by Aly Matejka/ Athletic Wellness & Exercise. I acknowledge that I have carefully read this “waiver and release” and fully understand that it is a release of liability. I expressly release and discharge the instructor from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action against Aly Matejka/ Athletic Wellness & Exercise for personal injury or property damage. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from. By purchasing this package, I acknowledge that I understand its content and that this release cannot be modified orally. I also understand that the content of this package is not a substitution for medical advise from my healthcare provider. All package sales are final and will not be refunded for any reason. By purchasing this package, I understand that its sale is final and that I will not be granted a refund for my purchase for any reason.
